For patients:
What personal data we collect and why we collect it

Sensitive Personal Data

CCI clinicians may need to make digital records of patient data, identifying information and medical helath records, and we may need to store or process this data.

With respect to the UK’s Common Law Duty of Confidentiality, CCI’s use of Personal Data is for the purposes of Direct Care and Administration, therefore a patient’s consent to such data sharing/Processing can be implied where the following conditions are met:

1.         The Personal Confidential Data is being accessed to provide or support an individual’s Direct Care, and shared for the same purpose;

2.         Information is readily available to patients to explain how their information will be used;

3.         There is no reason to believe the patient has objected;

4.         CCI is satisfied that the Processor of the Personal Data understands it has been given in confidence; and,

5.         CCI maintain Privacy Notices up to date and include the nature of data sharing actively communicated to patients.

CCI clinicians actively communicate to patients that in order to provide the healthcare services, we store and process their personal data – and sometimes share this data with other healthcare providers. It may also be necessary, where the latest technology allows us to do so, to use their information and health data to facilitate digital consultations and diagnoses and we will always do this with a patient’s security in mind.

Primarily this sensitive data is being processed for the purposes of the patient’s healthcare and therefore – to the extent a further legal basis is necessary – the processing required is justified under (i) Article 6(1)(e) (public functions) of the UK’s GDPR legislation; and (ii) in relation to special category personal data, Article 9(2)(h) (healthcare) of the GDPR and para 2, Schedule 1 of the DPA 2018.
